These Terms of Service ("Terms") govern your access to and use of kwenk.com, its subdomains, and related interactive services (the "Service"), operated by Quenq LLC ("Company," "we," "us," or "our").

By registering an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to all of these Terms, do not access or use the Service.

1. Eligibility & Account Security

  • Age Limit: You must be at least 13 years of age to use the Service. By creating an account, you represent and warrant that you are 13 or older.
  • Account Responsibility: You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or security breach.
  • Handle Reservation: Handles are assigned on a first-come, first-served basis. We reserve the right to reclaim or reassign handles that infringe trademarks, impersonate staff/brands, or remain inactive indefinitely.

2. User-Generated Content (UGC) & Profile Customization

Kwenk provides interactive features including wall posts, feeds, groups, blogs, private messaging, comments, and HTML/CSS profile skins ("User-Generated Content" or "UGC").

A. Ownership & License Grant

You retain full ownership of all intellectual property rights in the content you create and post on Kwenk. By posting UGC on the Service, you grant Quenq LLC a non-exclusive, worldwide, royalty-free, sublicensable license to store, host, display, reproduce, modify (for formatting and technical display purposes), and distribute your content solely for the purpose of operating, promoting, and rendering the Service.

B. Prohibited Content & Behavior

You agree that you will NOT upload, post, transmit, or otherwise distribute content that:

  • Is illegal, fraudulent, defamatory, libelous, or promotes illegal acts.
  • Contains Not-Safe-For-Work (NSFW) material, explicit pornography, or sexually explicit depictions.
  • Contains hate speech, racial slurs, harassment, stalking, or incitement of violence against individuals or protected groups.
  • Contains malicious code, scripts, keyloggers, phishing links, or exploits intended to bypass site security, capture visitor cookies, or disrupt the Service.
  • Consists of automated spam, commercial advertising, crypto/forex scams, or AI-generated low-quality text/media ("slop").
  • Infringes upon any third party's copyright, trademark, patent, trade secret, or privacy rights.

3. Moderation, Automated Scans & Account Termination

We use automated filtering systems ("Automod") and staff review to scan content before or after publication. Quenq LLC reserves the right, at its sole discretion, to:

  • Filter, edit, reject, or remove any UGC that violates these Terms or our community Rules.
  • Suspend, restrict, or permanently ban accounts that engage in repeated or severe rule violations.
  • Activate anti-raid protections, rate limits, or regional registration restrictions to protect platform stability.

4. Copyright Policy & DMCA Takedown Procedure

Quenq LLC respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content hosted on Kwenk infringes your copyright, please send a written DMCA Takedown Notice to our Designated Copyright Agent containing the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (including exact URLs).
  4. Your contact information (address, telephone number, and email address).
  5. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner.

5. Embedded Media Disclaimer

Kwenk indexes and embeds games and other interactive media hosted for historical preservation and educational purposes on our main site, quenq.com, and third-party archives. All games, trademarks, and media assets belong to their respective original authors and copyright holders. If you are a developer and wish to request removal of a preserved title, please contact us.

6. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY. QUENQ LLC DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, UNINTERRUPTED, OR THAT USER DATA WILL NEVER BE LOST.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL QUENQ LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY OR USER ON THE SERVICE; OR (III) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR TRANSMISSIONS.

8. Indemnification

You agree to defend, indemnify, and hold harmless Quenq LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your access to or use of the Service, your User-Generated Content, or your violation of these Terms.

9. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, United States, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in New Mexico, USA.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will post updated Terms on this page with a revised "Last Updated" date. Your continued use of the Service after any changes constitutes acceptance of the new Terms.
